Terms and Conditions

1. Client Responsibilities

 

1.1. Client is responsible for coordinating any decision-making with parties other than the PC.

 

1.2. Client must not act in a manner deemed unsafe, unprofessional, or capable of negatively impacting the overall production and its service prior to, during, or after the scheduled filming time and date(s).

 

1.3. Client and any other individuals must be present at the scheduled filming time and date(s).

 

1.4. Any delays caused by the Client and/or individuals involved will not be the responsibility of the PC. Additional time or shooting days not outlined in the contract will require an additional fee paid by the Client.

 

1.5. Delays caused by the venue/location are not the responsibility of the PC. Any inflicted costs from the venue will be the responsibility of the Client. Additionally, if these delays require further shooting time, the Client must pay the additional fee.

 

1.6. Client is responsible for paying all hiring costs for the venue/location used in production.

 

1.7. Client is responsible for covering all costs associated with any damage caused by the Client to the venue and/or equipment used in production.

 

2. Production Company Responsibilities

 

2.1. Delivery of the product will be through a format discussed and agreed upon by the PC and Client in pre-production.

 

2.2. The PC is responsible for covering any costs associated with any damage caused by the PC to the venue and/or equipment used in production.

 

3. Invoices and Payments

3.1. Payment of the production cost will be invoiced upon signing this contract, with a deposit of 50% of the total fee required at least 14 days prior to filming. The remaining sum will be required to be paid upon completion of all services offered. 

 

If a booking is made within 14 days before the shoot, the whole amount should be paid upfront.

 

3.2. Payments are to be made to the bank account shown on the invoice. Alternative methods of payments must be agreed upon with the PC.

 

Late payments

3.3. In the event of monies being owed within the agreed time, the Client will be notified by the PC. The PC has the right to terminate the Contract if the agreements are not met.

 

3.4. After receipt of notification, the Client will be charged statutory interest at a rate of 8% per late day until payment is received. 

 

3.5. An invoice for the cost of any interest due will be sent to the Client after late payment is received.

 

4. Amendments

4.1. The Client must inform the PC of any amendments to the shooting schedule as soon as possible. Amendments made without adequate notice may result in a reschedule of the shoot. If a reschedule of production is not possible, the Client may be liable to charges if there is no other option but to cancel (see Cancellations section 11).

 

4.2. The PC will allow for up to two free revisions for the final edit from Client feedback. Further amendments will be charged accordingly at half-day (4 hours) and full-day (8 hours) day rates.

 

8. Expenses

8.1. Travel fees are charged to the Client to the location(s) of filming and back to the PC’s base location.

 

8.2. Expenses required for refreshments and meals for the crew on shoot day(s) will be discussed prior and covered by the Client.

 

9. Equipment

9.1 Equipment needed to complete the job will be provided by the PC unless the Client requires the PC to use their equipment.

 

9.2. The PC cannot be held responsible for damage of Client or third-parties equipment.

 

9.3. Any additional hired equipment necessary for the production will be discussed between the PC and Client at the quote stage. Extra costs will be itemised on the invoice and paid by the Client.

 

10. Delivery

10.1. Product completion dates are agreed upon in the contract. Events beyond the control of the PC, including delays by the Client, changes in content and project, delays caused by third parties out of the control of the PC, and unforeseen events (a ‘force majeure’ event) may result in a delay in the delivery of the final product.

 

11. Cancellations

11.1. Cancellation of production by the Client 14 days or more before scheduled filming time and date(s) will result in 50% of the deposit being refunded to the Client. Associated admin and pre-production costs leading up to the scheduled shoot date(s) may be deducted from the deposit.

 

11.2. Cancellation of the production by Client within less than 14 days before scheduled filming date(s) will result in the deposit being nonrefundable unless a valid reason is provided by the Client.

 

11.3. Bookings made within 14 days of a scheduled shoot and cancelled before filming commences will be refunded the deposit minus any admin and pre-production fees.

 

11.4. Cancellation of production by PC may occur, or is considered if the Client (including peers) where to act in the following ways: 

11.4.1. Client fails to be present at scheduled filming time and date(s). 

11.4.2. Client actions and/or behaviour are deemed unprofessional and/or negatively impacting the overall production and its service prior to, during, or after the scheduled filming time and date(s). 

11.4.3. If the Client does not carry out their responsibilities agreed upon during the production.

 

11.5. If the PC does not receive the deposit from the Client by 14 days before the scheduled filming date(s) at the latest, production may be cancelled and will incur fees (see Cancellations section 11.2.)

 

11.6. Any associated costs paid to the PC towards the planning of production such as, but not limited to venue hire, equipment hire, or additional crew that have been arranged will be bound by their terms and conditions in the event of cancellation or rescheduling.

 

11.7. Costs will be refunded to the Client if a production is cancelled by the PC for reasons including but not limited to illness and/or unforeseen circumstances.

 

11.8. Official cancellation by either the Client or the PC must be accompanied by a valid explanation and must be in writing. 

 

11.9. The PC and Client have the right to terminate and/or reschedule the contract terms in a ‘force majeure event’ with no penalties or obligations to carry out the contract by either party. 

A ‘force majeure event’ is an unavoidable circumstance out of anyone’s control that includes, but is not limited to war, death, fires, illness, terrorism epidemics, ‘acts of God’ (earthquakes, floods, storms, or any other natural disaster), accident, national calamity, civil commotion, order of Government or Local Authority having jurisdiction in the matter, changes in law or foreign government policy.

 

11.10. No party is to be held responsible for any loss or is obligated to pay any fee for the cancellation of the Production under a ‘force majeure’ event. This does not include reasons related to Coronavirus. The PC or Client should be notified immediately in this scenario.

 

12. Product ownership

12.1. All versions of the product remain the sole intellectual property of the PC until complete payment of all monies owed is received. 

 

12.2. Until all monies owed are received by the PC, the Client does not own and may not publish any version of the Product in any form, including but not limited to online and on social media. 

 

12.3. Upon receipt of the full payment of all monies owed, the PC gives up sole ownership of the Product.

 

12.4. PC may use the product for promotional purposes unless discussed and agreed to in the contract.
